TET BONUS IS NOT COMPULSORY

Unlike salary, bonuses, including Tet bonus, are not compulsory expenses of employers to employees.

Article 103 of the Labor Code 2012 defines “bonuses” as follows: “Bonus is the amount of money that the employer rewards employees, based on the annual business results and the level of work performance of employees”.

Besides, according to Labor Code, the bonus policy is decided by the employer and made publicly available at the workplace after consultation with trade union.

Because neither the law requires employers to pay Tet bonuses for employees nor how much they have to pay Tet bonuses, therefore, in fact there are employers that reward their employees with billion dongs, or company products, or even no Tet bonus.
