PROCEDURES FOR ISSUANCE OF E-VISAS FOR FOREIGNERS

An electronic visa, also known as an e-visa, is a type of visa issued by the Immigration Department to foreigners through electronic transactions and has the symbol EV. E-visa plays an important role as bridge between countries, saves time and costs, avoids cumbersome procedures and is valid once and has a validity period of no more than 30 days. With many years of experience in consulting for customers from many different countries to enter Vietnam, LawPlus would like to review the regulations on electronic visa procedures for foreigners entering Vietnam into Vietnam.

1. Regulations on e-visa

Pursuant to Clause 5, Article 10 of the Law on Entry, Exit, Transit and Residence of foreigners in Vietnam, amended and supplemented in 2019, e-visas are issued to foreigners who have passports and are not eligible for issuance of visa types: NG1, NG2, NG3, NG4.

Foreigners who are abroad and wish to enter Vietnam can directly apply for an electronic visa or through an inviting or guaranteeing agency or organization. PROCEDURES FOR ISSUANCE OF E-VISAS FOR FOREIGNERS

Conditions to be granted an e-visa:

  • Foreigners who are abroad;
  • Have a valid passport;
  • Not falling into the cases where entry is not allowed as prescribed in Article 21 of the Unified Document of the Law on entry, exit, transit and residence of foreigners in Vietnam.

2. Procedures for electronic visa issuance at the request of foreigners

According to the provisions of Article 16a of the Consolidated document of the Law on Entry, Exit, Transit and Residence of foreigners in Vietnam, foreigners applying for an electronic visa shall do the following:

a. The order of execution

Step 1: Declare information to apply for an electronic visa, download a photo and passport ID page at the e-visa information page.

Electronic visa information page is an information page of the Immigration Portal, which has the function of receiving, processing and providing information related to electronic visa issuance.

Specifically, foreigners can access the electronic visa information page of the Immigration Portal (with the Vietnamese domain name “https://www.xuatnhapcanh.gov.vn”, the English is “” https://www.immigration.gov.vn”) to enter information to apply for an e-visa, download a portrait photo and passport ID page.

Step 2: Pay the visa fee to the account specified on the electronic visa information page after receiving the electronic file code from the immigration authority.PROCEDURES FOR ISSUANCE OF E-VISAS FOR FOREIGNERS

Step 3: Get the result.

Foreigners who apply for an electronic visa use the electronic file code to check the settlement results at the electronic visa information page, in case of being granted an electronic visa, use the electronic application code for electronic visa printing.

b. Dossiers

– Information about applying for an electronic visa (form NA1a) is posted on the electronic visa information page of the Immigration Portal.

– Portrait face photo 4 cm x 6 cm (Upload to e-visa information page).

– Photo of passport identity page (Upload to electronic visa information page).

– Processing time: no more than 03 working days from the date of receipt of sufficient information to apply for an electronic visa and visa fee.

Requirements and conditions for carrying out administrative procedures (if any):

+ Foreigners who are citizens of countries on the list to be.granted electronic visas according to the Resolution of the Government of Vietnam;

+ Foreigners who have passports and do not fall into the cases that are.not allowed to enter the country specified in Article 21 of the Law on entry, exit, transit and.residence of foreigners in Vietnam.

3. Procedures for issuance of electronic visas at the request of agencies and organizations

According to the provisions of Article 16b of the Consolidated Document of the Law on Entry, Exit, Transit, and Residence of foreigners in Vietnam, the agency or organization that applies for the issuance of an electronic visa to a foreigner has all the following requirements: the following conditions:

– Having an electronic account issued by the immigration authority as prescribed in Clause 2 of this Article;

– Having an electronic signature according to the provisions of the Law on Electronic Transactions.

a. The order of execution

Step 1: Agencies and organizations in Vietnam access the electronic visa information page of the Immigration Portal (with the Vietnamese domain name “https://www.xuatnhapcanh.gov.vn”) ”, English is “https://www.immigration.gov.vn”), use the provided electronic account to log in to the declaration and submit the electronic visa application.

Step 2: Enter the foreigner’s information, upload a portrait and passport ID page. After performing this step, the agency or organization will be issued an electronic file code by the system.

Step 3: Use an electronic signature to confirm the requested.information.

Step 4: Pay the visa fee to the account specified on the electronic visa information page.

Step 5: Get the result

+ Agencies and organizations use the electronic file code to check the settlement results at the electronic visa information page. to use the electronic file code to print the e-visa.

b. Dossier

Fill in the application form for an electronic visa according to Form NA1a issued together with Circular No. 57/2020/TT-BCA dated June 10, 2020 of the Ministry of Public Security posted on the website electronic visa information.

c. Requirements and conditions for carrying out administrative procedures (if any):

+ Agencies and organizations in Vietnam have electronic accounts as prescribed.in Clause 2, Article 16b of the Consolidation Document No. 27/VBHN-VPQH consolidating the Law on entry, exit,.transit and residence of foreigners issued by the Office of the National Assembly on December 16, 2019 and has an electronic signature in accordance with the.provisions of the Law on Electronic Transactions.

+ Foreigners must have passports and do not fall into the category of foreigners who are not.allowed to enter the country.specified in Article 21 of the Law on entry, exit, transit and residence of foreigners in Vietnam.
