Updated Regulations on Invoice Issuance for Exported Goods Effective June 1, 2025
On March 20, 2025, the Vietnamese Government issued Decree 70/2025/NĐ-CP, amending Decree 123/2020/NĐ-CP dated October 19, 2020, which provides guidelines on invoices and documentation. The new regulations introduce important changes, particularly regarding the timing for invoice issuance in export transactions.
Key Points of Decree 70/2025/NĐ-CP on Invoice Issuance
1. Timing for Invoice Issuance
The regulations on invoice issuance for exported goods specify different timelines based on the nature of the transaction:
- For Sale of Goods: Sellers issue invoices when ownership or use rights are transferred to the buyer, regardless of payment status.
- For Exported Goods (Including Outsourced Exports): Businesses decide when to issue electronic invoices, such as commercial invoices or VAT invoices. However, they must issue them no later than the next working day following customs clearance.
- For Service Provision: Providers issue invoices upon completing the service, irrespective of whether payment has been collected.
- For Advance Payments in Service Contracts: Invoices are issued when payment is received. However, exceptions apply to deposits or advance payments related to specific professional services, such as auditing, financial consulting, or project design.
2. Special Invoice Issuance Cases
Decree 70/2025/NĐ-CP also adjusts invoice issuance for specific activities:
- Regular bulk transactions requiring additional time for reconciliation between sellers and customers.
- Oil exploration, extraction, and processing activities.
- Foreign exchange services and monetary operations handled by credit institutions.
- Passenger transport services using electronic billing software.
- Healthcare services utilizing digital management systems.
Effective Date for Updated Regulations
The new invoice issuance regulations for exported goods in Vietnam will take effect on June 1, 2025, giving businesses ample time to adapt their invoicing processes.
